Mr. Reale:

This is in reply to your letter of December 2, 2003. As I don’t want to waste any more of your time on interpretation and explanation of the Zoning Ordinance as it pertains to Highland Estates, this letter does NOT require an answer!

Obviously, you must be aware that I disagree with your interpretation and implementation of the Zoning Ordinance as it applies to Highland Estates or any other development project.

I disagree with your interpretation of the Zoning Ordinance in the case of irregularly shaped lots and those lots that are connected to public street frontage via pipestems, albeit they have the required amount of frontage on the street.

In the case of Section 2-308, I am shocked to learn the staff uses the county-produced marine-clay overlay map to calculate density in those cases where more detailed engineering is available.

As I understand it, the marine-clay overlay map implementation is subject to final engineering. In the case of Highland Estates, the overlay map showed a portion of the site in marine clay while the developer’s own soils report revealed that the entire site contained marine clay. I am enclosing a copy of marine-clay map and the relevant portion of the engineer’s soils report in an effort to make my point.

I trust a review of the Ordinances and their method implementation will provide more strict guidance for evaluation of future development submissions.I look forward to participating in the process that will help the County reach those goals.

I would appreciate you providing a copy of this letter by inter-office mail to Mr. Shoup, Ms. Kirst, Mr. Nassembini and Mr. Freidman. Please convey to each my thanks for their efforts on this case and the upcoming ordinance amendment. I am providing a copy to Supervisor Kauffman under separate cover.
