RE: Board of Zoning Appeals Approval of SPA 69-L-055, Rose Hill Farms Community Center, Inc.
To my chagrin, the Fairfax County Board of Zoning Appeals (BZA) approved SPA 69-L-055 this morning. I am concerned that the BZA did not fully consider, the soil characteristics of the subject property. There is a long history of problems with soil stability in the Rose Hill Community that have been documented in the past by homeowners and identified by County Staff in their review of other applications in the area. Unfortunately the BZA approved this case without specific development conditions dealing with soil stability and protections for adjacent property owners for potential property damage.
Attached is a letter I sent to the BZA and a letter the Rose Hill Civic Association submitted concerning this application.
I request that your office coordinate a thorough evaluation of the site to determine the following:
1. Can an appeal of the BZA approval be filed by the County?
2. What sort of protections do adjacent property owners have from potential property damage off site?
3. What sort of protections are afforded to the future new homeowners that assure them there will not be future damage to their homes because of unstable soils?
